The Shire of Derby/West Kimberley is committed to upholding the legislative requirements that are set in order to enforce penalties for breaches and non-compliances with approvals related to developments within our region.
We encourage all stakeholders to engage with us early in the planning process of developments. The Shire would like to reassure the community we are here to assist and open communication allows us to provide guidance, ensuring that projects align with regulatory requirements and contribute positively to our community.
It is crucial to recognise that penalties and legal action are considered as the last resort. It is important for us to work collaboratively with developers, fostering a proactive approach to address potential issues before they escalate. Our goal is to facilitate responsible and lawful development while ensuring the well-being and safety of our community.
Recent legal proceedings at the Derby Magistrates Court on 21 February 2024 have highlighted the importance of maintaining adherence to these regulations. Following the court proceedings there have been penalties imposed on Norbuilt Pty Ltd due to an unlawful development on 8 Wells Street, Derby. The court, after due consideration, imposed a total fine, including the Shire’s costs, of $21,400 on the accused company.
We remind all stakeholders that these actions are taken to maintain orderly planning and development, promoting public safety and welfare. The Shire of Derby/West Kimberley appreciates the cooperation of the community and reiterates our commitment to fostering responsible and lawful development.
